These Terms of Use are an agreement between you and TBA WESTCOAST LLC, the publisher of WallTime under the Arbor Intelligence brand. By downloading or using WallTime, you agree to these terms.
If you cannot agree to these terms, do not use the app. If you are not legally able to enter this agreement, a parent or legal guardian must review and accept it for you.
What WallTime is
WallTime is a local iPhone timer and personal activity record for wall-staring sessions. It can record session duration, maintain local stats and challenges, optionally capture a wall photo after a completed session, and generate an image you may choose to share.
WallTime is not a medical device and does not provide medical advice, diagnosis, treatment, or health recommendations.
License
Subject to these terms and Apple's applicable App Store terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use WallTime on Apple devices you own or control.
Acceptable use
- Use the app only for lawful, personal purposes.
- Do not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code except where applicable law expressly permits it.
- Do not interfere with the app's operation or use it to violate another person's rights.
Your photos and sharing choices
You retain your rights in photos and generated images created with your content. You are responsible for the content you choose to capture or share and for complying with the rules of the destination service.
WallTime does not run a social network or publish content on your behalf. Instagram and other share destinations are third-party services with their own terms and privacy practices.
Accounts, purchases, and availability
WallTime version 1.0 has no account, login, in-app purchase, or subscription. We may update, change, suspend, or discontinue features in a future version, subject to applicable law and App Store requirements.
No warranties
To the fullest extent permitted by law, WallTime is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We do not warrant that the app will always be available, uninterrupted, or error-free.
Limitation of liability
To the fullest extent permitted by law, TBA WESTCOAST LLC and its members, employees, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use WallTime. Nothing in these terms limits liability that cannot legally be limited.
Governing law
These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules, except where the law in your place of residence requires otherwise.
Changes to these terms
We may update these terms for future versions of WallTime. The effective date above identifies the current version. Continued use after an update becomes effective means you accept the revised terms.
